Children’s Issues

In most circumstances, before to going to Court in children’s matters it is compulsory to attempt to resolve the dispute though specialised mediation called family dispute resolution (FDR) with a registered family dispute resolution practitioner (an FDRP).

The aim of FDR is to encourage parents to try and agree arrangements in relation to their children without having to go to Court. FDR is an inexpensive and less stressful method for many parents to resolve their dispute.

Before attending FDR you may wish to obtain legal advice so that you:

  • Can focus on what is most important at mediation;
  • are aware of your options, particularly what the outcome could be if you do go to Court;
  • know the difference between parenting plans and Consent Orders.

You may even want us to attend with you and represent you at the mediation. We often represent parties at mediation.

Generally, before to going to Court in property / financial matters it is compulsory to attempt to resolve the dispute though dispute resolution (mediation). The aim of mediation is to encourage parties to try and agree arrangements in relation to their financial and property matters without having to go to Court. Mediation is an inexpensive and less stressful method for many parties to resolve their dispute.

At CLT Family Law we recommend you obtain legal advice before engaging in mediation or negotiations for financial/property settlement.

  • advise your on options to formalise any agreement reached.

CLT Family Law strongly recommends that you formalise any financial / property settlement and you at least obtain independent legal advice before doing so.

Pre and Post Steps to Family Law Mediation

CLT Family Law offers a fixed price initial consultation during which time, we can provide referrals to Dispute Resolution / Mediation services, advise you on the process and provide you with advice as set out above.

Some service providers or models of mediation allow you to have your lawyer present, CLT Family Law will regularly represent and support participants in mediation.

If at mediation you reach an agreement with the other party and you wish to formalise the agreement with Consent Orders, CLT Family Law can assist you with the preparation of an Application for Consent Orders for an affordable fixed fee.
